The use of the Site by any person (hereinafter “you” or “the user”), regardless of the purpose of their visit, is governed by these general terms of use (hereinafter the “Terms of Use”). The purpose of the Terms of Use is to define the conditions of access, browsing, and use of the Site.

By accessing and using the Site, you unreservedly accept the application of the Terms of Use.

We reserve the right to modify and/or update these Terms of Use by publishing a new version on our Site. We therefore invite you to consult them regularly.

To access the Site, you must have reached the minimum legal age for the consumption and/or purchase of alcohol according to the legislation in force in your place of residence (the higher age being taken into consideration). If no legal age exists in your place of residence, you must be at least 21 years old to access the Site.

 

1. BROWSING THE SITE

1.1. ACCESS TO THE SITE

The hardware and software required to access the Internet and the Site are the responsibility of the users of the Site. The Company reserves the right, at its sole discretion, to suspend or terminate access to all or part of the Site, its content, or services offered on the Site, without prior notice and, to the extent permitted by law, without this giving rise to any right to compensation for the user.

1.2 HYPERLINKS

The Site may provide links to other websites or other Internet sources. Since the Company cannot control these sites and external sources, the Company cannot be held responsible for the content, advertising, products, services, or any other material available on or from these external sites or sources. Furthermore, the Company cannot be held liable for any damage or loss (whether actual or alleged) resulting directly or indirectly from the use of the content, goods, or services available on these other sites or external sources.

1.3 USER CONDUCT

Each user of the Site warrants that they:

  • have the legal age required to consume and/or purchase alcohol according to the legislation in force in their place of residence;
  • use the Site for lawful purposes only, excluding any use for commercial purposes unless with the prior written consent of the Company;
  • where applicable, provide accurate, truthful, and up-to-date data.

Users are prohibited from making any statements and/or acting or claiming to act in the name and/or on behalf of the Company, its subsidiaries, and affiliated companies, as well as their respective shareholders, directors, officers, and employees, for any reason whatsoever.

Users must behave responsibly, lawfully, courteously, and respectfully towards the rights of other users of the Site, the Company, its affiliates, and third parties.

In particular, the user must refrain from:

  • uploading to the Site, posting, emailing, or transmitting by any means any material containing software viruses or other computer codes, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment;
  • disrupting or interrupting the operation of the Site, servers, or networks connected to the Site, or violating any requirements, procedures, rules, or regulations connected thereto;
  • harming or attempting to harm the functioning of the Site, notably by exposing the Site to a virus, causing an overload of traffic (bandwidth), overloading the server, sending “spam,” or overloading the Site’s email service;
  • accessing confidential Company information not intended for them or accessing a server or account operated by the Company without authorization;
  • attempting to probe, scan, or test the vulnerability of the Site and/or breach the Site’s security or authentication measures without the prior written consent of the Company;
  • engaging in any unlawful activity or any other activity that could harm the rights of the Company, its suppliers, service providers, retailers, advertisers, or others, and encouraging third parties to engage in such activities;
  • uploading to the Site, transmitting, posting, or otherwise making available any unsolicited or unauthorized advertising or promotional materials, “junk mail,” “spam,” “chain letters,” or any other form of solicitation;
  • uploading to the Site, posting, emailing, or transmitting by any means any content that the Company reasonably deems, at its sole discretion, to be illegal, harmful, defamatory, offensive, racist, vulgar, obscene, threatening, violent, immoral, invasive of a person’s privacy, reprehensible, or shocking, in particular from a racial or ethnic standpoint, or any other objectionable content;
  • emailing or transmitting by any other means any content or Site to persons who are not of legal age to consume and/or purchase alcohol in their place of residence, or who reside in a location where advertising alcoholic beverages is restricted or prohibited.

Each user undertakes to comply with all applicable laws, rules, and procedures relating to online user conduct and the transmission of technical data.

Where applicable, and to the extent permitted by law, the Company may terminate at any time a user’s right to access the Site if they fail to comply with their obligations under these Terms of Use and/or any other document, without prejudice to the Company’s right to claim damages.

2. PROTECTION OF SITE CONTENT

2.1 COMPANY CONTENT

The Site as a whole, together with each of its individual elements (including, without limitation, text, structure, logic, animations, photographs, illustrations, images, videos, diagrams, soundtracks, logos, trademarks, designs, and models), as well as the software necessary for the operation of the Site, databases, and newsletters (collectively, the “Company Content”), is protected by applicable French and international laws relating to copyright, trademarks, database rights, and other intellectual property rights.

Unless expressly stated otherwise on the Site, all intellectual property rights in the Company Content are owned exclusively by the Company. No rights are granted to users other than a limited, personal right to access and use the Site for non-commercial, personal purposes only.

Any reproduction, distribution, or use of the Company Content, in whole or in part, for any purpose other than personal use, in any manner or form whatsoever, is expressly prohibited.

Users are further prohibited from copying, modifying, creating derivative works from, assembling, decompiling, assigning, sublicensing, or otherwise transferring any rights in or to the Company Content or the Site.

2.2 DATABASES

The databases made available on the Site are protected under the French Intellectual Property Code. Any substantial extraction or reuse, whether quantitative or qualitative, of these databases without the Company’s prior consent is prohibited.

2.3 TRADEMARKS AND LOGOS

The trademarks and logos displayed on the Site are the registered property of the Company or its third-party licensors. Any reproduction, imitation, or use, in whole or in part, of these distinctive signs without the express prior authorization of the rights holder constitutes an infringement and may result in legal liability.

Other distinctive signs displayed on the Site, such as corporate names, trade names, business names, and domain names, belong to the Company or third parties. Any reproduction or use thereof without express authorization may constitute an infringement and render the user liable.

4. LIABILITY

The Company makes no representation or warranty as to the accuracy, completeness, or reliability of the information made available to users on the Site.

Access to the Site is provided free of charge, and to the fullest extent permitted by applicable law, the Company disclaims all liability, including but not limited to liability for:

  • any interruption of access to the Site;
  • the occurrence of bugs, viruses, display or download errors;

5. GOVERNING LAW AND JURISDICTION

These Terms of Use, together with the Privacy and Cookies Policy applicable to the Site, shall be governed by and construed in accordance with the laws of France.

Subject to any mandatory legal provisions to the contrary, any dispute arising out of or in connection with the content or use of the Site shall be submitted to the exclusive jurisdiction of the competent courts at the Company’s registered office, even in cases of summary proceedings, third-party claims, multiple defendants, or related actions.
